Man given five penalty points and fined for driving 52mph in a 30mph zone

An Aberdeen man has been given five penalty points and a £360 fine for speeding in Macduff in his partner’s car.

Colin Cumming, 32, of Park Drive, Aberdeen, pleaded guilty to a charge of speeding at Banff Sheriff Court yesterday.

Police caught him driving at 52mph on the A98, known as Buchan Street, well above the 30mph limit in the area.

Depute fiscal Anna Chisholm told the court it was a dry day weather-wise and there was only a light traffic flow on the evening in question – May 12 last year.

She said: “It was shortly after 8pm.

“The accused was recorded travelling at 52 miles per hour while the road was restricted to 30.”

Cumming’s defence agent Kevin Anderson told the court that it was his client’s first time using that road.

He said: “Mr Cummings was in his partner’s car and he fully accepts his speed was higher than acceptable on the road.

“He asked me to extend his apologies to the court and shouldn’t have driven at that speed which is gross in the circumstances.”

Considering the facts, Justice of the Peace Gary Johnston said: “I do consider the speed to be quite high and will impose five penalty points onto your licence.”

He also fined Cumming £360, reduced due to the early guilty plea.
