Shetland man collided with metal railing in early morning crash

Sentence has been deferred on a 26 year old man whose careless driving resulted in his car colliding with metal railing on Lerwick’s Hillhead in the early hours of Saturday morning.

Shaun Irvine, of Scalloway, appeared from custody at Lerwick Sheriff Court on Monday to admit the driving charge, as well as being abusive to and assaulting officers at Lerwick Police Station.

Procurator fiscal Duncan Mackenzie said police discovered damage to the railing, along with debris from the vehicle including a burnt number plate, at around 1.30am on Saturday.

They then noticed the vehicle heading towards them. Irvine failed a preliminary roadside breath test and was arrested and taken along the road to the police station.

Mackenzie said Irvine’s behaviour at the station was “so violent that it proved impossible” for further procedures to be carried out – making it “a lucky escape for him in some respects”.

Irvine admitted behaving in a threatening or abusive manner by shouting abusive and derogatory remarks. He also pleaded guilty to assaulting a constable in the execution of his duty, attempting to headbutt him, acting in an aggressive manner, tensing up his body and struggling violently with the officer.

Defence agent Tommy Allan said his client was “very much stricken with remorse” and had little recollection of events. He said Irvine had also apologised for his conduct at the station.

Sheriff Philip Mann deferred sentence until 5 July for a criminal justice social inquiry report to be prepared and Irvine was released from custody in the meantime.
