An SNP councillor is facing three different criminal charges of ignoring a planning enforcement notice which was served by the local authority on which he is a member.
Calum MacMillan, 53, and his wife Lynne, face charges of failing to ensure their wind turbine on their croft at 7 Bornish, South Uist, was inactive during the hours of 11pm and 7am on weekdays and on weekends, in order to limit noise disruption.
The case was called at Lochmaddy Sheriff Court yesterday and continued to May 21 without plea.
An enforcement notice was served by Comhairle nan Eilean Siar (Western Isles Council) which instructed the MacMillans to ensure that they complied with planning conditions by March 2018.
It is alleged that between August 2 that year and March 5 this year the Enercon wind turbine was in operation through the night “on all days” and “in breach of noise levels” as laid down by the planning permission granted.
Mr MacMillan was elected in 2017 to represent the Barra, Vatersay, Eriskay and South Uist ward for the SNP. He is also a director of the community landlord, Storas Uibhist.
