A pregnant taxi driver was showered with broken glass after a beer bottle was kicked at the vehicle she was driving.

John Fraser, described as a prisoner at Perth, kicked the empty bottle towards the taxi while with friends in Forres on November 27.

Just an hour earlier the 24-year-old had launched an unprovoked attack on a man in the town’s Grantown Road – knocking him to the ground and repeatedly punching him on the head and body.

Fraser appeared at Elgin Sheriff Court yesterday for sentence after previously admitting the offences.

Fiscal Kevin Corrins told the court the 24-year-old was walking with friends shortly after midnight when the group met Danny Pugh.

Without warning Fraser repeatedly punched his victim and continued the attack after knocking him to the ground before Mr Pugh was able to escape to a friend’s house to phone the police.

Later in the early hours, shortly before 2am, the 24-year-old kicked a bottle at a taxi being driven by Kym Michie – who was 30 weeks pregnant at the time – in the town’s Grant Drive.

Mr Corrins said: “She’s aware there are people at the side of the road and they are in possession of beer bottles, which the accused kicks in the direction of the taxi.

“Due to the distance she’s unable to take evasive action and the bottle smashes the driver’s door window and thereafter hits her on the side of the head, along with shattered glass.”

Mrs Michie was taken to hospital by ambulance to be treated for cuts on her face and hands.

Fraser’s agent, solicitor Stephen Carty, said that while the attack on Mr Pugh was unprovoked, at the time there was a “significant history” between the men.

He added: “Clearly he had no intention of kicking the bottle towards the taxi or making it come into contact with anybody.

“He had consumed alcohol that evening and it had a significant effect on his behaviour.”

Sentence was further deferred to calculate compensation for Mrs Michie.

Fraser will return to court on February 16 after admitting culpably and recklessly kicking the bottle towards the taxi and assaulting Gavin Pugh.
