91-year-old driver fell asleep at the wheel and crashed into wall on Moray road

A 91-year-old Moray man has been banned from the road – despite already having had his licence taken away from him on medical grounds.

Ernest Roberts, of Morriston Road, Elgin, fell asleep at the wheel and crashed into wall on the B9015 on May 1, 2015.

The pensioner was then left in legal limbo for more than a year as efforts were made to determine his fitness to drive.

Proceedings were held up as his solicitor Stephen Carty struggled to find a doctor willing to rule on his fitness.

At Elgin Sheriff Court yesterday, Mr Carty said his client had now had his licence revoked on health grounds by the DVLA.

He said: “Due to the nature of the charge Mr Roberts has not been driving anyway – and doesn’t want to drive again.

“He has the right to appeal the decision to take his licence away but doesn’t intend to.”

Roberts, who was 89 when the crash happened, lost control of his car while driving between Rothes and Inchberry.

Fiscal Alison Wylie said: “It went straight into the wall – his vehicle was substantially damaged in the collision.”

Roberts, who was not present in court yesterday, was banned from driving for 12 months after admitting driving carelessly at an earlier hearing.
