Drink driver was five-times over limit and had 11-month-old baby in back

A north-east woman who got behind the wheel while more than five times the legal alcohol limit – with an 11-month-old in the back seat – will have to wait to learn her fate.

Marion Stephen was warned she faced jail when she admitted committing her second drink-drive offence at Aberdeen Sheriff Court last month.

She had been caught driving with 115 microgrammes of alcohol in 100 millilitres of breath. The legal limit is 22mcg.

Sentence was deferred until yesterday for background reports, but they had not been carried out and the case was put off until the new year.

Last month, the court heard officers had been responding to a report of a car being driven erratically on the A96 Huntly to Aberdeen road when they came across Stephen’s blue Land Rover.

It was parked on the grass verge near Bogside, and when they approached they could see the 33-year-old trying to get out of car.

A road side breath test showed she was more than five times the legal limit and officers found an 11-month-old child strapped into the back seat.

Sheriff William Taylor told her at the time it was “appalling” for a drunk woman to drive with a baby in the car and said given her previous conviction all options, including prison, would be open to him when he considered sentencing.

Yesterday Stephen, of 5 Paradise Road, Kemnay, had her bail continued until her sentencing next year.
