An Inverness man suffered a fractured cheek bone when he fell down stairs after being punched and kicked at a party.
But Inverness Sheriff Court heard that 37-year-old Jody Mackenzie couldn’t have surgery on his injury because he had a “very serious illness” which increased the risk for him.
Yesterday, 20-year-old Ryan Simpson of Peffery Road, Dingwall, admitted a charge of assault to severe injury which occurred in a house in Inverness’s Mackay Road on April 22 last year.
Sentence was deferred until next month for a background report and his defence solicitor David Patterson reserved his comments until then.
Fiscal depute Michelle Molley told Sheriff Margaret Neilson that Simpson had taken exception to the attention Mr Mackenzie was paying to a girl at the party.
“He took it upon himself to eject Mr Mackenzie, punched him once to the head, opened the front door and kicked him on the body, causing him to fall down a flight of stairs, striking his head off the ground.
“Shortly thereafter, he turned up at another house in Hilton where there was also a party and made comments that he had just hit Jody.
“He later left with the young woman he had objected to Jody Mackenzie speaking to.”
Ms Molley said that police found Mr Mackenzie heavily intoxicated after being called to an alleged disturbance at another house in Hilton.
“He had obvious injuries to his face. He was taken by ambulance to Raigmore Hospital where he was found to have a cut to his right ear, swelling around his right eye and a fracture to his right cheek bone.
“He was referred to the Maxillofacial Unit but following a consultation there, Mr Mackenzie, who was suffering from a very serious illness, refused further treatment due to the risks involved with surgery.”
