A furious dad branded pool staff “Nazis” in a foul-mouthed rant after his children were turned away from swimming lessons.

Iain Kelly was overcome by a wave of anger when he took his children to the pool at Deeside Community Education Centre in Aboyne only to be told they didn’t “meet the requirements”.

The 40-year-old raged at swimming pool staff “you’re all f****** Nazis” and “it’s just a f****** slide”.

He was later found in the changing room area “swearing and ranting to himself”.

Fiscal depute Tom Procter told Aberdeen Sheriff Court staff were conducting swimming tests for children to participate in at 1.15pm on June 5 2022.

He said: “The accused arrived with his two children and they were unable to meet the requirements and were asked to vacate the swimming area.

“The accused became aggressive, shouting and swearing at the complainers.”

‘You’re making a big mistake speaking to me like this’

Kelly yelled: “This is f****** bull****, I paid for this, my kids can swim.”

The dad was then taken into an office area where he continued to be aggressive, squaring up to a female employee and shouting: “You’re all f****** Nazis. It’s a f****** slide.”

He was asked to leave, but when the manager attended the changing room area they found Kelly “swearing and ranting to himself”.

Kelly went on to shout: “This is some f***** up Nazi s***.”

He also told a manager to “f*** off”.

On being asked to leave again, Kelly responded: “You’re making a big mistake speaking to me like this.”

The manager, who is a foreign national, stated he was going to call the police and Kelly “started to mock him by repeating what he was saying, mimicking his accent”.

‘Chased her upstairs and demanded to know who she was on the phone to’

Kelly then left and was later traced by police.

Kelly, of Tarland, pled guilty to a racially aggravated charge of behaving in a threatening or abusive manner.

He also admitted separate charges of engaging in a course of conduct that was abusive of his ex-partner and between May 1 2022 and July 11 2022, and resisting, obstructing or hindering police.

Regarding the domestic offence, Mr Procter said the pair had been in a relationship for 10 years but separated in May 2022.

He said that since the break-up, Kelly has become “increasingly jealous”, regularly calling her and, if she did not answer, assuming she was with another man.

On an occasion at the start of July, Kelly took and smashed the woman’s phone when he saw her receive a text from a male friend.

On July 10, she was awoken at 11.20pm by the sound of Kelly arriving outside her address in his car uninvited.

Kelly then smashed a glass panel in the door and went inside, walking straight to the lavatory.

‘Unhealthy lifestyle revolving around alcohol misuse’

The woman, who had dialled 999, came downstairs while on the phone before Kelly “chased her upstairs into the bedroom and demanded to know who she was on the phone to”.

She managed to push him out of the room and he left before being traced by police later.

On being arrested, Kelly began to flail his arms and struggle with officers.

Defence agent David Sutherland said social work reports, which are not made public, covered the offences.

He added: “There’s nothing to add to what’s said within the reports.”

He also said Kelly had an “unhealthy lifestyle revolving around alcohol misuse” and that he’d taken steps to address that.

Sheriff Morag McLaughlin handed Kelly 15 months of supervision and 162 hours of unpaid work.
