Aberdeen man banned from the road for a decade

A man has been banned from the roads for 10 years after he admitted committing his second drink-driving offence.

Malcolm Stewart appeared from custody at Aberdeen Sheriff Court yesterday and pleaded guilty to committing three road traffic offences at the weekend.

The court heard the 50-year-old drank about five pints at a wedding before deciding to drive to his ex-wife’s home.

Fiscal depute Stephanie Ross said police had noticed his car at around 12.20am on Saturday as he had a head light out and planned to stop him.

However Stewart pulled the car over himself on Hallfield Road before running away from the scene.

Miss Ross said that when officers eventually caught up with Stewart he was foaming at the mouth, smelled strongly of alcohol and was unsteady on his feet.

The court heard Stewart, of 193 School Drive, Aberdeen, then refused to give a roadside breath test. He further refused to carry out another test when they arrested him and took him to Kittybrewster Police Station.

Yesterday Stewart admitted driving while unfit to do so through drink or drugs and failing to take the breath tests when required to.

Sheriff Annella Cowan said that because he had a previous conviction for the same thing she was imposing 100 hours of unpaid work to be carried out within six months.

She further disqualified him from driving for 10 years.
