A man was jailed for three years on Friday after raping a woman following consensual sexual activity with her.

Dean Still, 30, assaulted the victim who said no to a particular sex act at a house in Stonehaven, in Aberdeenshire.

Still, formerly of Cowie Park, Stonehaven, had denied raping the woman on June 23 in 2018  during an earlier trial but was convicted of the offence by the jury.

A judge told him at the High Court in Edinburgh: “What was clear was both of you were very drunk at the time.”

Lady Scott said rape was always a serious offence but added that she did not accept an assessment of Still as posing a high risk.

The judge said there was little apparent account having been taken of protective factors in a report which came to that conclusion.

Lady Scott said he had agreed to take part in any relevant programmes that were available and added: “You are three years older and you have no history of sexual offending.”

She said that Still was well regarded in his community for the contribution he made and charity work.

Defence counsel Lorraine Glancy said he had maintained the position he had taken in the case from the outset when a background report was prepared on him.

She said he continued to enjoy the support of his family, friends and partner.

The defence counsel said that Still accepted that a period of imprisonment would follow from his conviction.

He was placed on the sex offenders’ register.
