Man who assaulted ex-partner warned by sheriff that incident ‘not funny’

A man who assaulted his ex-partner after she smeared ice cream on his door had to be warned by a sheriff the matter was “not funny”.

Shaun Rose had just broken up with the woman when she smeared the frozen dessert on a communal door at his home on Skene Street in Aberdeen.

When she also began to move miniature statuettes around the garden area, the 44-year-old “saw red” and went to confront her, pushing and struggling with her.

But as the details of the case were narrated in court, Rose’s reaction irritated Sheriff Rory Bannerman, who warned him to stop laughing.

‘I don’t find it in the slightest amusing’

Fiscal depute Andrew McMann told Aberdeen Sheriff Court: “At 5.30pm on July 3, the accused and complainer were at the locus when an argument took place between them where the accused pushed the complainer and struggled with her.

“In fairness to the accused, the complainer does struggle with him to the point where she rips his T-shirt.”

The assault was also caught on CCTV.

Rose, of Skene Street, Aberdeen, pled guilty to a charge of assault, as well as a separate charge of breaching a bail condition.

Defence agent Bruce MacDonald began to explain that the assault had occurred when the woman smeared ice cream on Rose’s door when the sheriff had to interrupt due to Rose’s amused reaction in the dock.

Sheriff Bannerman said: “This is not funny.

‘I’m afraid Mr Rose saw red’

“I don’t find it in the slightest amusing so please behave in the court.”

Mr MacDonald explained the couple had been childhood friends and began a romantic relationship in February.

However, it quickly became toxic and, on the day in question, Rose asked the woman to leave.

She had gathered her things into bags and gone down to the street below when the incident occurred.

He continued: “He’d seen that she had smeared ice cream all over the communal door and moved various statuettes from a neighbour’s garden.

“I’m afraid Mr Rose saw red and came down to the street to where the complainer was standing.

“He saw red and pushed her to one side, picked up a bag and threw it away.

“She took hold of him and there was a bit of a struggle and his T-shirt was ripped.”

Sheriff Bannerman fined Rose a total of £520 and imposed a one-year non-harassment order.
