Takeaway delivery driver was more than three times limit – the day after drinking session

A delivery driver for a Chinese takeaway has been banned from the road after being caught drink-driving.

Police caught Bennett McCash behind the wheel while more than three times the legal alcohol limit following a call from a concerned member of the public.

McCash had worked as a self-employed delivery driver for the Chinese takeaway for 13 years but has now lost his job following the incident.

When he was stopped, during the late afternoon, the 64-year-old was still more than triple the legal alcohol limit from drinking the night before.

‘Significant error of judgement’

Fiscal depute Lydia Ross told Aberdeen Sheriff Court the incident happened on the A92 Stonehaven to Aberdeen road near Newtonhill at 4.40pm on March 11.

She said: “Police received a call in relation to the vehicle from a member of the public.

“Police attended and observed the vehicle. The accused was found to be the sole occupant and smelled strongly of alcohol.”

McCash, of Promenade Court, Aberdeen, pled guilty to driving with 71 microgrammes of alcohol in 100ml of breath. The legal limit is 22 microgrammes.

Defence agent Donna Seivewright said her client had been unemployed since the date of the offence.

She said he had been drinking into the early hours of March 11 and had made a “significant error of judgement”.

Sheriff Mark Thorley said: “This is quite a high reading and a worrying reading considering this was the day after you’d been drinking.”

He fined him £420 and banned him from driving for 16 months.
