Drink-driver bit police officer then refused to be breathalysed

A drink-driving carwash attendant who sank his teeth into a police officer after being arrested has said he is “extremely ashamed” of his behaviour.

Stoycho Marinov, 35, drove up to a police cordon in Aberdeen and spoke to officers, who noticed his eyes were glassy and speech was slurred.

Aberdeen Sheriff Court heard that as Marinov was escorted to custody in a police van he bit a female officer on the arm.

He then refused to consent to two separate breath tests at the police station.

Fiscal depute Kirsty Martin told the court that on September 23 2021 police had closed off Hallfield Road in Aberdeen when Marinov drove up in his black Ford Focus and stopped behind a police car.

‘They immediately smelled alcohol on his breath’

“The road had been closed earlier that evening and a police vehicle was blocking the street,” she said.

“Officers approached the accused’s vehicle and told him the road would be closed for a time.

“They immediately smelled alcohol on his breath and noted his eyes were glazed and his speech was slurred.”

Marinov provided a positive breath test for alcohol at the roadside and was arrested.

As he was taken to Kittybrewster Police Station in a secure vehicle he pushed one officer to the ground and bit a female constable on the arm.

While being booked in at the station, Marinov then refused to provide a sample of breath on two occasions “without a reasonable excuse”.

Marinov, a Bulgarian national, pleaded guilty to one charge of driving a motor vehicle while unfit to drive through drink or drugs and two charges of assaulting a police officer.

He also admitted a further charge of failing to provide two specimens of breath.

‘He has very little recollection of his behaviour’

Defence agent Jenny Logan told the court her client had made the “stupid decision” to drive after going out drinking with work friends.

“He has very little recollection of his behaviour thereafter,” she said.

“Mr Marinov has shown genuine remorse for his behaviour and he is extremely ashamed and embarrassed.”

Sheriff David Hall fined Marinov, of Manor Walk, Aberdeen, a total of £865 and disqualified him from driving for 15 months.
