Pair fined for ‘out of character’ violent assaults on Paramount pubgoer

A pair of revellers who attacked a man after a “misunderstanding” in an Aberdeen bar have each been fined.

Scott Montgomery punched his victim 10 times to the face until he fell to the ground.

Montgomery, 32, had to be dragged off the man by co-accused Jaime Cook, 30, in the Bon Accord Street bar during the fallout at 12.10am on April 27, Aberdeen Sheriff Court was told.

The pair then left the bar in the direction of Union Street, but their victim caught up and kicked Montgomery in the back, causing him to fall to the ground.

Accomplice Cook then retaliated with a one-punch blow that took their victim to the ground.

The incidents were captured on CCTV and the victim suffered minor injuries including cuts and swelling to his face.

Montgomery and Cook both admitted a charge of assault to injury at the earliest opportunity.

Defence agent Iain Hingston said the assault was “very much out of character” for Montgomery, who is a work coordinator and is employed full-time.

“It’s a matter of profound embarrassment and he is truly apologetic and remorseful,” he said.

“It was a misunderstanding. This is the evil sometimes of alcohol and he accepts that’s an explanation and not an excuse. We are not likely to see him in court again.”

Assault had ‘potential for much more serious consequences’

Solicitor Chris Maitland, for Cook, added that his client was in a “well-paid job” and was “genuinely remorseful”.

“Mr Cook was not involved in the incident inside the bar and outside the complainer is the one who instigated physicality. Unfortunately, Mr Cook reacted as described with a single punch.”

Sheriff Margaret Hodge told both men that alcohol was no excuse and reminded them that “any assault where somebody ends up on the ground has potential for much more serious consequences”.

Montgomery, of Pilmuir Road West, Forres, and Cook, of Shaw Crescent, Aberdeen, were both fined £420.
