Inverness man accused of distributing extreme pornographic images to learn his fate

A jury will resume considering a verdict this morning in the trial of a man accused of distributing extreme pornographic images of a woman he knew.

Jurors at Inverness Sheriff Court were sent home yesterday afternoon after failing to reach a conclusion in the four day trial of Daniel Garden of Woodlands Park, Inverness.

The 25 year old denies downloading and possessing indecent images of children, videos and stills of bestiality and distributing a number of those videos.

The content of some of them was of the woman with a dog, which his alleged victim said she did “to please him (Garden).”

Some of the videos later appeared on a social media page of hers, which she said she had been locked out of.

The trial also heard from Facebook friends who were sent them from her deactivated page.

In his closing speech, defence solicitor Graham Mann asked the jury to acquit his client because “we only have her word for it that he had them.

“There is no evidence that he ever possessed the videos that were distributed. The police did not recover any electronic equipment from her yet she admitted searching for other pornographic material.”

Mr Mann added: “Is this not a case of the baby who cried the loudest? You have been short-changed here and not been shown the full picture.”

But fiscal depute Roderick Urquhart asked the jury to convict on all charges.

“No-one else had access to his computer and he was the only one who had her password.

“Everything points to Daniel Garden in this unpleasant case.”
