Racist warehouseman branded food truck owner ‘monkey’ in breakfast row

James Walker "lost control" after a misunderstanding led to him being refused food

A racist warehouseman has been fined after calling a food truck owner a “monkey” for refusing to serve him.

Aberdeen Sheriff Court heard the matter had initially been a “misunderstanding”, but that didn’t stop James Walker, 22, from unleashing the foul-mouthed rant.

Fiscal depute Rebecca Thompson the incident happened on the Altens Industrial Estate at around 9am on March 26 2022.

She said another man went to the food truck to place an order on Walker’s behalf.

Ms Thompson said: “He politely informed him he would not serve the accused food.”

Told he wouldn’t be served

However, 25 minutes later, a furious Walker appeared and barked: “Why the f*** you not serving me? What have I ever done to you?”

He added: “You’re a f****** cheeky c***, eh?”

Sheriff Morag McLaughlin asked the fiscal: “What was after ‘c***’?”

She clarified and spelled out the word “eh”.

Walker then went on to slam the door of the food truck while the owner repeatedly asked him to leave and again told him he wouldn’t be served.

Ms Thompson said: “The accused began backing away, shouting and swearing, calling him names including ‘monkey’, ‘gimp’ and ‘p***’.”

Walker did then leave the Hareness Road food truck and returned to his place of work.

‘I hope you’ll learn from this’

Walker, of Aboyne Place, Aberdeen, pled guilty to acting in a racially aggravated manner.

Defence agent John McLeod said it had initially been a “misunderstanding” that led to his client not being served.

He explained: “The complainer had experience of other persons, not my client, ordering food and then not paying for it.”

The lawyer added: “It’s plain Mr Walker was very, very angry. He lost control.”

Sheriff McLaughlin told Walker: “It’s never acceptable to use that sort of racial slur. People shouldn’t have to put up with that.

“I hope you’ll learn from this.”

She ordered him to pay a fine of £790.
